PLEASE READ THE FOLLOWING TERMS AND CONDITIONS OF USE CAREFULLY BEFORE USING THIS WEBSITE. All users of this site agree that access to and use of this site are subject to the following terms and conditions and other applicable law. If you do not agree to these terms and conditions, please do not use this site.
Terms: No Warranty is stated or implied due to the unusual and extreme stresses placed on high performance parts and because we have no control over how they are installed or used. No returns on special order or non-stocking parts. All returned merchandise must be in like new, unmodified condition and must be Preauthorized. All returns are subject to a 20% restocking charge. No returns after 30 days. Deposits are used to secure an order and therefore are not refundable. Abandoned parts and or merchandise (no customer payment activity for 90 days) will be charged a $4.00 a day storage charge and become the property of D.S.S. inc. when the value of the goods equals the storage charges owed. Some products sold may not be legal on pollution-controlled vehicles. Check your State and local laws.

D.S.S. Parts Warranty Disclaimer
Due to the Nature of their intended use (IE , high performance and Racing). D.S.S. Hereby expressly disclaims all Warranties, either expressed or implied in law, including any implied warranty of merchantability or implied warranty of fitness for a particular purpose and neither assumes nor authorizes any other entity or persons to assume any liability in connection with is parts and/or products. D.S.S. INC. shall not, under any circumstances be liable for any special, incidental or consequential damages of any kind arising from the purchase, installation, or use of their products. Purchaser agrees to wave potential recovery against D.S.S. INC. to the extent that purchaser has purchased insurance coverage for the loss at issue, In the event, purchaser has purchased insurance coverage for the loss at issue, purchaser hereby agrees to seek only those damages which are covered under this agreement and are not covered by insurance. The user assumes all liability for the use of these products. D.S.S. reserves the right to make product updates without notice and without incurring liability with respect to products previously manufactured. Check your state & local laws as these parts may not be legal for use on pollution-controlled vehicles. Parts sold by D.S.S. Inc. but manufactured by others are solely covered by that manufacturer's warranty. The parties to this contract agree that the contract and corresponding sale shall be considered to have taken place in Kane County, Illinois and that the agreement shall be interpreted in accordance with the laws and regulations of the State of Illinois and that the corresponding sale shall be governed by the laws and regulations of the State of Illinois. Purchaser agrees to jurisdiction in the State of Illinois. In the event of legal action involving this agreement and corresponding sale, purchaser agrees that the exclusive venue for such legal action shall be in the Circuit Court of Kane County, Illinois.
WARNING: Building performance vehicles and racing is dangerous and involves considerable risk. Racing should never be done on public roads. Racing should only be done at sanctioned racetracks and events with proper safety equipment and personnel present.
Damages / Shortages
Please inspect your merchandise immediately upon delivery. If possible, inspect your order completely while the driver is still present and note any damages on the freight bill or bill of lading. If any damages are found after delivery, please call the freight company immediately for an inspection. DO NOT RETURN DAMAGED PARTS TO US. The carrier will take all necessary steps to settle the claim. Damaged items returned to us without filing a claim will not be covered. If any shortages are found contact us immediately. We do not allow claims after 3 days have elapsed.
Returns / Exchanges / Shipping Errors
We accept returns for un-installed items in their original packaging up to 30 days from date of purchase. You must call D.S.S. Inc. before returning any item. You will receive an RGA (Return Goods Authorization) number that must be clearly marked on the outside of the package to be returned. You must also include a copy of the original invoice with the returned item. Failure to comply may result in a delayed or denied result. Authorization to return an item should not be interpreted as final approval of return status. All returns are carefully inspected to determine sales worthiness as a new item. All returned items must be in unused condition and in undamaged original packaging. Used, altered or damaged merchandise will not be refunded. In the event that an item is not approved as a return, it is the purchaser's responsibility to pay for any shipping charges incurred should he/she wish the product be returned. All returns are subject to a 20% restocking fee + credit card bank fees. Shipping charges are not refundable. Return freight must be prepaid. No returns on special order items.
Restriction of LiabilityD.S.S. inc. shall not be liable for any special or consequential damages that result from the use of, or the inability to use, the materials on this site or the performance of the products, even if D.S.S. inc. has been advised of the possibility of such damages. Applicable law may not allow the limitation of exclusion of liability or incidental or consequential damages, so the above limitation or exclusion may not apply to you.
Typographical Errors
In the event that a D.S.S. inc. product is mistakenly listed at an incorrect price, D.S.S. inc. reserves the right to refuse or cancel any orders placed for product listed at the incorrect price. D.S.S. inc. reserves the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, D.S.S. inc. shall issue a credit to your credit card account in the amount of the incorrect price.
Term; Termination
These terms and conditions are applicable to you upon your accessing the site and/or completing the registration or shopping process. These terms and conditions, or any part of them, may be terminated by D.S.S. inc. without notice at any time, for any reason. The provisions relating to Copyrights, Trademark, Disclaimer, Limitation of Liability, Indemnification and Miscellaneous, shall survive any termination.

D.S.S. inc. may deliver notice to you by means of e-mail, a general notice on the site, or by other reliable method to the address you have provided to D.S.S. inc.
Miscellaneous
Your use of this site shall be governed in all respects by the laws of the state of California, U.S.A., without regard to choose of law provisions, and not by the 1980 U.N. Convention on contracts for the international sale of goods. You agree that jurisdiction over and venue in any legal proceeding directly or indirectly arising out of or relating to this site (including but not limited to the purchase of D.S.S. inc. products) shall be in the state or federal courts located in Los Angeles County, California. Any cause of action or claim you may have with respect to the site (including but not limited to the purchase of D.S.S. inc. products) must be commenced within one (1) year after the claim or cause of action arises. D.S.S. inc.'s failure to insist upon or enforce strict performance of any provision of these terms and conditions shall not be construed as a waiver of any provision or right. Neither the course of conduct between the parties nor trade practice shall act to modify any of these terms and conditions. D.S.S. inc. may assign its rights and duties under this Agreement to any party at any time without notice to you.
Use of Site
Harassment in any manner or form on the site, including via e-mail, chat, or by use of obscene or abusive language, is strictly forbidden. Impersonation of others, including a D.S.S. inc. or other licensed employee, host, or representative, as well as other members or visitors on the site is prohibited. You may not upload to, distribute, or otherwise publish through the site any content which is libelous, defamatory, obscene, threatening, invasive of privacy or publicity rights, abusive, illegal, or otherwise objectionable which may constitute or encourage a criminal offense, violate the rights of any party or which may otherwise give rise to liability or violate any law. You may not upload commercial content on the site or use the site to solicit others to join or become members of any other commercial online service or other organization.

D.S.S. inc. does not and cannot review all communications and materials posted to or created by users accessing the site and is not in any manner responsible for the content of these communications and materials. You acknowledge that by providing you with the ability to view and distribute user-generated content on the site, D.S.S. inc. is merely acting as a passive conduit for such distribution and is not undertaking any obligation or liability relating to any contents or activities on the site. However, D.S.S. inc. reserves the right to block or remove communications or materials that it determines to be (a) abusive, defamatory, or obscene, (b) fraudulent, deceptive, or misleading, (c) in violation of a copyright, trademark or other intellectual property right of another or (d) offensive or otherwise unacceptable to D.S.S. inc. in its sole discretion.

You agree to indemnify, defend, and hold harmless D.S.S. inc., its officers, directors, employees, agents, licensors and suppliers (collectively the "Service Providers") from and against all losses, expenses, damages and costs, including reasonable attorneys' fees, resulting from any violation of these terms and conditions or any activity related to your account (including negligent or wrongful conduct) by you or any other person accessing the site using your Internet account.

However, even if the third party is affiliated with D.S.S. inc., www.dssracing.com has no control over these linked sites, all of which have separate privacy and data collection practices, independent of D.S.S. inc. These linked sites are only for your convenience and therefore you access them at your own risk. Nonetheless, D.S.S. inc. seeks to protect the integrity of its web site and the links placed upon it and therefore requests any feedback on not only its own site, but for sites it links to as well (including if a specific link does not work).
